Alena Michaels LLC Retreat Waiver

Terms & Conditions

 

Definitions

As used in this Agreement, "Alena Michaels LLC" shall mean the “Company” (including, but not limited to, any current and future employees, staff, principals, associates, and other related persons), “Us”, and “We.”

 

As used in this Agreement, “You”, “Your”, and “I” shall mean you, individually, as the attendee of the Retreat. 

 

Booking
Your booking is not considered definite, and no contract will exist until we receive the agreed deposit from you and you agree to these terms and conditions set forth herein. 

 

Payment
(a) The price is the exact amount to be received by us in the currency on the website and to be received by the designated due date (as specified on the website). 

(b) After the non-refundable deposit is made, the first payment and the remaining balance will be due as specified on the website.

(c) You will receive a reminder email one week prior to the due date. If full payment is not received by this deadline, we reserve the right to cancel your reservation and fill your spot.
 

Your Travel Arrangements
All travel arrangements are your responsibility and are incurred at your own cost. We shall not be held liable for any consequences arising from delays or cancellations caused by third parties, including from unaffiliated persons or companies you may have made travel arrangements with, or for any issues in your documentation required for travel. 

 

Travel Insurance
Travel insurance is highly recommended for overseas trips. The Company will not be providing or offering travel insurance, and booking travel insurance is your responsibility. 

 

Your Health
(a) It is your responsibility to let the retreat organizers know if you have any injuries and to be mindful at all times of your own body’s capability during the retreat.
(b) It is also your responsibility to advise us of any mental or physical health conditions and dietary requirements before you book.
(c) Whilst all measures are taken to ensure a high standard of health and safety, sometimes we may be situated in the natural area and other places where the land is uneven, and we shall not be responsible for any injuries caused by uneven terrain. 

 

Cancellation by You
Should you choose to cancel your booking; no refunds are provided. You will be offered a credit toward a future retreat or other service/courses.

 

Amendments by Us 

Occasionally, changes may have to be made to the types of activities and services provided by Us during the retreat, including, but not limited to, changes to the provider, facilitator, retreat schedule, activity times, or any other arrangements which we reserve the right to do at any time.

 

Cancellation

We reserve the right in any circumstances to cancel a retreat. A full refund will be provided.

 

No Liability for Possessions
It is your responsibility to ensure that your possessions are kept safe at all times. We are not liable for loss of, damage to, or theft of any of your personal property.  

 

Privacy Policy
Your privacy is important to the Company. We do not share your customer details with any third parties. Any personal information that you provide to us will be used only for the purposes of this agreement.

 

Photography & Videography

As a participant, you agree that we may publish any photographs, videos, and digital or social media of the trip or participants in printed or electronic media without obtaining your prior consent and without compensation. You release us and our representatives from any liability in connection with any use of such photographs, videos, and digital and/or social media.
 

COVID-19 Policy 

As of 2024, the stringent COVID-19 testing requirements for travel have been relaxed. However, we advise each participant to independently verify the latest travel advisories and health protocols related to their trip to Mexico. While the Company may assist in providing information, the onus of adhering to any existing guidelines lies with the participants, ensuring their own safety and compliance.

By deciding to join our retreat, participants acknowledge the inherent risks associated with exposure to COVID-19 and other illnesses during their travel and stay. It is understood that travel conditions and public health guidelines are subject to change, and these changes may affect your retreat experience. Participants accept that no refunds will be provided for modifications in booking due to such unforeseen circumstances, emphasizing the importance of personal responsibility in health and travel decisions.

 

Flights & Transportation 

(a) If the company, Alena Michaels LLC, is organizing free transport to/from the airport, it is your responsibility to provide your full flight details to Alena Michaels LLC (the company) at least one and a half months in advance, otherwise you may have to organize your own transport. 

(b) The slots for transport will be arranged and you must arrive/leave during one of those designated slots, otherwise arrange your own transport if the times are not suitable. 

 

Company’s Obligations 

(a) We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide for are to a reasonable standard.

 

Limitation of Liability

(a) We do not accept any liability for unforeseeable events, including, but not limited to: cancellations, delays or changes caused by war, the threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.
(b) We are not liable for any injuries you may incur. All the activities, workshops, experiences, and anything else is undertaken at your own risk. We are not liable for any medical or psychiatric conditions which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property. 

(c) I agree to fully release and hold harmless Alena Michaels LLC and all members of staff, associates, employees, owners, providers or facilitators from and against any and all claims or liability of whatsoever kind or nature arising out of or in connection with this agreement. 

(d) I agree that I shall not in any way conduct myself inappropriately. 

(e) I understand that I am free to withdraw from or reduce my participation in the activities, programs, and sessions at any time and will not be requesting compensation for activities I did not participate in.

(f) I acknowledge and understand that I am using the facilities at the Retreats at my own risk. I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which you might incur as a result of participating in the services offered on and off the premises at which Alena Michael LLC’s Retreats operate.

(g) This agreement is intended to constitute a complete release of any responsibility by Alena Michaels LLC and other retreat facilitators, organizers, providers, officers, agents, and/or employees, suppliers, and other retreat members (releasees) for personal injuries and/or property loss/damage sustained by me, while attending the retreat, whether engaged in the offered services or not.

(h) I agree to indemnify and hold harmless from any and all liability and damages incurred arising out of my conduct or activity while attending the retreat or participating in offered services.

 

Choice of Law

This Agreement shall be construed pursuant to and governed by the laws of the State of Florida.

 

Agreement

This shall constitute a binding agreement for mutual consideration of both parties. This agreement constitutes the whole. 

 

By electronically checking the waiver box, and submitting my non-refundable deposit, I hereby acknowledge and accept all the terms and conditions above. I hereby agree to be responsible for my own welfare and accept any and all risks, including, but not limited to: delay, unanticipated events, inconvenience, illness, injury, emotional trauma, or death. I hereby release and discharge Alena Michaels, and retreat leaders from and against any and all liability from my participation in the retreat trip. I agree that this release shall be legally binding upon me personally.
